These Terms of Business explain the basis on which James Property Mortgages, a trading name of James Property Mortgages Ltd (a company registered in England and Wales, Company Number 15766411), provides its services to you. By contacting us or using our services, you agree to these terms. Please read them carefully and keep a copy for your records.

2. Our service — introducer only
We are not authorised or regulated by the Financial Conduct Authority. We act as an introducer only and do not provide financial advice, recommendations, or arrange mortgage or other financial products.
Our role is strictly limited to introducing you to a third-party mortgage broker, adviser, or lender that is authorised and regulated by the Financial Conduct Authority (FCA). Specifically:

• We do not give advice on, recommend, or comment on the suitability of any mortgage, loan, insurance, or other financial product.
• We do not arrange, administer, or process any financial product or contract.
• We do not assess your eligibility, affordability, or creditworthiness.
• Any advice, recommendation, or product you receive will come from the FCA-regulated firm we introduce you to, not from us.

3. The regulated firm
Once we introduce you to an FCA-regulated firm, your relationship with that firm is separate from your relationship with us and is governed by that firm’s own terms of business. That firm is responsible for the regulated advice it gives, the products it arranges, and the way it handles your information. We recommend you read and understand that firm’s terms and privacy policy before proceeding.
You are under no obligation to proceed with any firm we introduce you to, and you are free to seek advice or arrange products elsewhere at any time.

4. How we are paid
Our introduction service is provided to you free of charge. We may receive a fee or commission from the third-party firm for introducing you to them. Where we do, this will not increase the amount you pay to that firm and will not affect the advice or products they offer you. You may ask us for details of any such arrangement at any time.

5. Your responsibilities
To allow us to make an appropriate introduction, you agree to provide information that is accurate, complete, and not misleading. We rely on the information you give us when deciding which firm to introduce you to, and we are not responsible for the consequences of any inaccurate or incomplete information you provide.

6. Consent to share your information
By using our service, you consent to us passing your details to a third-party FCA-regulated firm so that they can contact you and provide regulated advice or arrange a product. The way we handle your personal information is explained in our Privacy Policy, which forms part of these terms.

7. No liability for third parties
We are not responsible for the advice, conduct, products, fees, or services of any third-party firm we introduce you to, nor for any loss arising from your dealings with them. Any complaint about the advice given or product arranged should be directed to the regulated firm concerned, which will have its own complaints procedure and access to the Financial Ombudsman Service where applicable.

8. Limitation of liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot lawfully be excluded. Subject to that, we are not liable for any loss or damage arising from our introduction service except to the extent it is directly caused by our own negligence, and we are not liable for any indirect or consequential loss.

9. Conflicts of interest
We take reasonable steps to identify and manage any conflicts of interest that may arise from our introducer arrangements. If we become aware of a conflict that may affect our service to you, we will tell you.

10. Complaints
If you are unhappy with our introduction service, please contact us using the details in section 13 and we will do our best to resolve the matter. As we are not authorised or regulated by the FCA, complaints about our introduction service are not covered by the Financial Ombudsman Service. Complaints about regulated advice or products are handled by the regulated firm concerned.

11. Governing law
These terms are governed by the laws of England and Wales, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to these terms
We may update these terms from time to time. The latest version will always be available on our website, with the “Last updated” date showing when it was last revised.
